By accessing our platform, you agree to these Terms of Service, which outline the rules and guidelines necessary to ensure a safe and seamless experience for all Kasting users.

1. About Kasting

Kasting is a technology platform operated by Media Mania Mashup Mingle Mixer, Inc. (hereinafter "The Company, Inc. "we," "us," or "our"). The platform facilitates connections between two types of users: "Kasters," who post roles, and "Seekers," who apply for and fulfill those roles for compensation.

Kasting is a technology platform only. We are not an employer, staffing agency, talent agency, casting company, escort service, entertainment company, or labor provider of any kind. We provide the tools. Everything else happens between you and the other party.

2. Acceptance Of Terms

By creating an account, accessing, or using the Kasting platform in any capacity, you agree to be bound by these Terms of Service. If you do not agree, you may not use the platform.

These Terms constitute a legally binding agreement between you and The Company, Inc.

3. Eligibility

You must be at least 21 years of age to create an account or use this platform in any capacity — whether as a Kaster or a Seeker.

By creating an account, you represent and warrant that:

• You are at least 21 years of age

• You have the legal capacity to enter into a binding agreement

• You are not prohibited from using the platform under any applicable law

Kasting does not conduct independent age verification beyond your representation at signup. If you misrepresent your age, your account will be permanently terminated, and you may be subject to legal liability.

Kasters are solely responsible for verifying the age of any Seeker upon meeting in person. Kasting bears no responsibility whatsoever for any misrepresentation of age by any user.

4. The Platform

Kasting provides the following tools and services:

• The ability for Kasters to post role descriptions and set compensation amounts

• The ability for Seekers to browse, filter, and apply for posted roles

• A secure payment hold system managed through our third-party payment processor

• A review system for both parties following role completion

• A dispute resolution system accessible through the app

• The ability to report and block other users

Kasting does not:

• Create, assign, or recommend roles or Seekers

• Supervise or monitor any in-person interaction

• Guarantee the behavior, reliability, safety, or suitability of any user

• Endorse any user or any role posted on the platform

• Assume responsibility for any outcome of any in-person meeting or engagement

5. 100% Platonic And Hands-Off Mandate

Kasting is strictly a marketplace platform of hands-off social roles, atmosphere event performances, and platonic social interaction.

The following are strictly and unequivocally prohibited:

• Any form of physical contact beyond what is explicitly described and agreed upon in the role brief

• Any romantic or sexual solicitation, arrangement, or conduct of any kind

• Any arrangement that constitutes or resembles escort services in any jurisdiction

• Any role that a reasonable person would interpret as sexual, exploitative, or inappropriate in nature

Violation of this clause will result in immediate permanent account termination, forfeiture of all platform fees, and may be reported to applicable law enforcement authorities. Kasting reserves the right to make this determination at its sole discretion.

6. Prohibited Uses

The following are strictly prohibited. Violation will result in immediate permanent account termination, forfeiture of any held funds, and may be reported to applicable law enforcement:

• Any arrangement involving sexual services, escort services, or companionship of a sexual nature

• Any role intended to deceive any court, judge, attorney, law enforcement officer, or government agency

• Any role intended to deceive any financial institution, lender, investor, insurer, or corporate stakeholder for the purpose of obtaining money, credit, loans, investment, or insurance proceeds

• Any role involving immigration fraud, visa fraud, or misrepresentation to any immigration authority

• Any role designed to defame, harass, intimidate, stalk, or harm any specific real person

• Any role involving the impersonation of a real, identifiable private individual without that person's explicit written consent

• Any involvement of minors in any role in any capacity whatsoever

• Any role designed to facilitate any criminal activity of any kind

• Any role involving election fraud, voter suppression, or political deception

• Any role used in connection with any estate, probate, or inheritance proceeding for fraudulent purposes

• Any use of the platform to collect, harvest, sell, or misuse another user's personal information

• Any attempt to circumvent these prohibitions by disguising the true nature of a posted role

• Any unauthorized recording, screenshotting, or capture of any platform communication, user profile, or in-app content for the purpose of distribution, publication, or exploitation outside the platform

Kasting reserves the right to remove any content and terminate any account at our sole discretion at any time without notice or explanation.

6a. More Prohibited Uses (certain social, family, business, and relationship roles):

Any role involving a third party who is unaware they are interacting with a Seeker must not be used to: secure money, credit, or a business deal through misrepresentation; appear in legal, immigration, custody, or government proceedings; harass, stalk, or target a specific individual; or serve as an undisclosed paid endorsement in advertising or testimonials.

7. Independent Contractor Status

Seekers are independent contractors. They are not employees, agents, partners, or representatives of The Company, Inc. or Kasting in any capacity.

Kasting does not:

• Direct, control, or supervise the work of any Seeker

• Set the hours, schedule, or working conditions of any Seeker

• Provide equipment, tools, insurance, or benefits to any Seeker

• Guarantee any minimum earnings to any Seeker

Seekers set their own availability, accept or decline any role entirely at their own discretion, and are solely and entirely responsible for:

• Their own federal, state, provincial, and local tax obligations

• Reporting their own income to the applicable tax authorities in their jurisdiction

• Their own insurance and personal liability

• Their own compliance with all applicable laws

Kasting will issue applicable tax documentation where required by law when earnings thresholds are met. Seekers acknowledge and accept full responsibility for all tax obligations arising from compensation received through the platform.

Nothing in these Terms creates or implies an employment relationship, partnership, joint venture, or agency relationship between The Company, Inc. and any user.

8. Role Compensation And Scope

Compensation for each role is fixed by the Kaster at the time of posting and is binding upon acceptance. Kasting does not set, adjust, or guarantee any compensation amount.

Seeker is not required to perform any work outside the agreed role scope as described in the platform listing. Any request by a Kaster for additional work beyond the listed scope is not part of the enforceable agreement unless explicitly updated and accepted through the Kasting platform prior to performance.

If a dispute arises regarding scope or compensation, the Seeker may submit a dispute through the in-app dispute function with supporting evidence. Kasting will review the original role brief, timestamps, and any submitted evidence and make a determination based on the agreed scope.

If a Kaster is found to have materially misrepresented the agreed scope, Kasting may apply platform remedies, including but not limited to refunds from funds already held, account restrictions, or permanent removal from the platform. Kasting’s liability in such matters is strictly limited to funds actually received and held through its third-party payment processor for the specific transaction at issue.

Both parties confirm the start of a role through the app, which timestamps the engagement for record-keeping purposes. Kasting takes 0% commission on role compensation amounts; this compensation is set entirely by the Kaster.

9. Identity And Misrepresentation

All users are required to represent themselves accurately and honestly on the platform at all times. Your profile, photo, age, and any information submitted to the platform must be truthful and current.

If a Seeker arrives at a role and the Kaster determines in good faith that the Seeker is not who their profile represents — including but not limited to a different physical appearance, age, or identity — the Kaster has the right to cancel the engagement immediately. In such cases:

• The Kaster's escrowed role payment is refunded in full

• The Seeker forfeits all compensation for the role

• The Seeker's platform fee is not refunded

• The matter may be escalated through the in-app dispute function and may result in permanent account termination

Kasting does not verify user identities and bears no liability for any misrepresentation by any user. Identity disputes are handled through the in-app dispute resolution system, and Kasting's determination is final.

10. No Background Checks Or Vetting

Kasting does not conduct background checks, criminal record checks, identity verification, reference checks, or vetting of any kind on any user — whether Kaster or Seeker. We make no representations or warranties regarding the character, conduct, honesty, integrity, or suitability of any user on the platform.

By using Kasting, you acknowledge and accept that:

• You are interacting with individuals who have not been screened or verified by Kasting in any way

• Any decision to meet, engage, or transact with another user is made entirely at your own risk

• Any in-person meeting, arrangement, or engagement facilitated through the platform occurs entirely outside of Kasting's control and at your sole risk

• Kasting bears no responsibility whatsoever for any outcome of any in-person interaction, including but not limited to personal injury, death, property damage, theft, assault, harassment, emotional distress, or harm of any kind

• Kasting is a technology platform only — what happens between two parties outside of the app is entirely beyond our control and entirely outside our legal responsibility

Use this platform at your own risk. Exercise your own judgment. Your safety is your responsibility.

11. Alcohol, Substances, And External Conditions

Kasting does not control the environments in which roles take place. Roles may occur at events or venues where alcohol or other legal substances are present. Kasters may specify such conditions in the role description, and Seekers are encouraged to review all role details carefully before applying.

By accepting a role, the Seeker acknowledges and accepts the conditions described in the role brief as consenting adults. Kasting bears no liability for any outcome arising from alcohol consumption, environmental conditions, or any circumstances occurring outside the platform during or after a role.

12. Minors At Events

Users must be 21 or older to use this platform. If a role takes place at an event where minors may be present, this does not exempt any user from their obligations under these Terms. Any user found to have misrepresented their age or to have knowingly involved a minor in any role capacity will be immediately and permanently banned and may be reported to applicable law enforcement. Kasting bears no liability for any interaction involving minors that occurs outside the platform.

13. Safety

Kasting strongly recommends all users follow these safety practices:

• Meet for the first time in a public location

• Do not share your home address until you are comfortable with the other party

• Inform a trusted person of your whereabouts and plans before any in-person meeting

• Trust your instincts — if something feels wrong, leave immediately

These are recommendations only. Kasting is not responsible for your physical safety. You voluntarily assume all risk associated with in-person meetings arranged through this platform.

14. Currency And Conversion

All transactions on the Kasting platform are processed in US Dollars (USD). Any currency conversion fees, exchange rate fluctuations, international card processing fees, or bank charges incurred as a result of a transaction are the sole responsibility of the user. Kasting is not liable for any variance between the USD amount charged and the amount reflected in a user's local currency on their bank or card statement.

15. Payment And Escrow

All financial transactions, payment holds, and fund distribution on the Kasting platform are managed exclusively by our designated third-party payment processor. Kasting does not handle, hold, or have direct access to user funds at any time. By using the platform, you agree to be bound by the terms and conditions of our third-party payment processor.

A platform fee applies to both posting and applying for a role, which may be updated at our discretion. The applicable fee is clearly disclosed at checkout before any payment is processed. Platform fees are charged for access to Kasting's marketplace tools only and do not constitute Kasting's participation in, endorsement of, or responsibility for any role, transaction, or in-person interaction. Compensation for completed gigs is determined by the Kaster and held by our designated third-party payment processor until release; Kasting takes 0% commission on gig compensation.

Platform fees are non-refundable except in the following circumstances: if a Kaster declines a Seeker's application, the Seeker's platform fee is automatically refunded in full. In all other circumstances, including account termination for violation of these Terms, platform fees are forfeited without exception.

Payment Release: Funds held for role compensation are released to the Seeker when:

• The Seeker submits a rating and review confirming role completion, OR

• 48 hours pass after the scheduled role end time with no dispute filed by either party

15a. Disputes: Either party may file a dispute during a role or within 48 hours of the scheduled role end time using the in-app dispute function. During an active dispute, all held funds are frozen until resolution. Kasting's decision on all disputes is final and binding. By using the platform, both parties agree to accept Kasting's dispute resolution decisions as final and waive any further recourse against Kasting arising from a dispute outcome.

Kasting is not liable for any losses, damages, or harm arising from any dispute outcome.

15b. Off-Platform Circumvention

Kasting strongly discourages arranging future roles outside the platform. Off-platform arrangements are not monitored, protected by Kasting's dispute resolution process, payment hold system, refund eligibility, or review/credential system. Kasting bears no liability for any injury, loss, non-payment, or harm arising from arrangements made outside the platform, even where the parties originally met through Kasting.

15c. Copyright Infringement

Kasting respects intellectual property rights and expects all users to do the same. You may not post, upload, or submit any content to the platform that infringes the copyright, trademark, or other intellectual property rights of any third party.

If you believe that any content on the Kasting platform infringes your copyright, please notify us at legal@kasting.app with the following:

• A description of the copyrighted work you claim has been infringed

• The location of the infringing content on the platform

• Your contact information

• A statement that you have a good faith belief that the use is not authorized by the copyright owner

• A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

Kasting will review all valid notices and remove infringing content where appropriate. Repeat infringers will be permanently banned from the platform.

This process is intended to comply with the Digital Millennium Copyright Act (DMCA) and applicable international copyright laws.

15d. Third Party Links

The Kasting platform may contain links to third-party websites or services. Kasting is not responsible for the content, accuracy, privacy practices, or reliability of any third-party site. Links do not constitute endorsement. You access third-party sites entirely at your own risk.

16. Reviews

Reviews may be submitted by both parties following role completion. Reviews must be truthful and based on actual firsthand experience. Kasting reserves the right to remove any review that is defamatory, fraudulent, retaliatory, or in violation of these Terms. The submission of a review by the Seeker serves as confirmation of role completion and triggers payment release. Reviews contribute to a user's credential/reputation history on the platform.

17. Reporting And Blocking

Both Kasters and Seekers may report or block any other user at any time using the in-app report and block functions. Reports are reviewed by Kasting. Kasting reserves the right to remove any user from the platform at our sole discretion at any time without notice or explanation.

17a. Selection And Discrimination

Kasters retain full discretion to select or decline any Seeker for any role for any reason, except those prohibited by applicable law. Kasting is a private marketplace platform and does not govern or regulate Kaster's selection decisions. Kasting is not liable for any claim arising from a Kaster's decision to accept or decline any Seeker application.

If a Seeker believes they have been declined in bad faith or in violation of applicable law, they may report the Kaster through the in-app report function. Kasting will review the report and reserves the right to remove any user found to be in violation of our community standards. Our sole remedy is platform-level — we are not a court, and our decisions carry no legal weight beyond access to the platform.

18. Force Majeure

Kasting shall not be held liable for any failure or delay in platform operation or service resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, governmental actions, cyberattacks, third-party service failures, or any other event of force majeure. In the event the platform is rendered inoperable, Kasting will use commercially reasonable efforts to refund all escrowed funds to the applicable parties. Where such a refund is not possible due to the nature of the event, Kasting bears no further liability.

19. Data Security And Breach

Kasting collects and retains minimal user data necessary for platform operation. In the event of a data breach affecting your personal information, Kasting will notify affected users as required by applicable law and will take commercially reasonable steps to mitigate harm. Given the minimal nature of data we hold, the risk and impact of any breach is inherently limited. Kasting's liability in any data breach event is limited to the maximum extent permitted by applicable law.

19a. Errors And Platform Accuracy

Kasting makes no warranty that the platform will be error-free, uninterrupted, or free of technical defects. We do not guarantee the accuracy of any user-generated content, including role descriptions, profiles, reviews, or compensation amounts. We reserve the right to correct any errors or inaccuracies on the platform at any time without notice. Kasting is not liable for any loss or damage arising from any platform error, outage, or inaccuracy.

19b. Notifications

By creating an account, you consent to receive platform notifications via email and in-app messages regarding your account activity, including but not limited to role applications, acceptances, declines, payments, disputes, and platform updates. You may manage your notification preferences within the app. Opting out of certain notifications may affect your ability to use platform features effectively. Kasting is not liable for any missed notifications resulting from your notification settings or technical delivery failure.

19c. Location Services

Kasting uses your device location to show you relevant roles in your area. By using the platform, you consent to location access as configured on your device. You may disable location services at any time through your device settings. If you choose to disable location access, Kasting cannot guarantee the accuracy or relevance of roles displayed to you, and certain platform features may be limited or unavailable. Kasting is not liable for any missed opportunities or reduced functionality resulting from your choice to disable location services.

19d. Analytics And Platform Data

Kasting collects anonymized usage and analytics data to improve platform performance, user experience, and safety. This data does not identify you personally and is used solely for internal platform purposes. By using the platform, you consent to this collection. We do not share analytics data with third-party advertisers or marketing platforms. All analytics data is governed by our Privacy Policy.

20. Limitation Of Liability

To the maximum extent permitted by applicable law, The Company, Inc. and Kasting are not liable for:

• Any injury, death, property damage, emotional distress, or harm of any kind arising from any in-person meeting or engagement arranged through the platform

• Any fraud, misrepresentation, or prohibited conduct by any user

• Any financial loss arising from any dispute outcome

• Any loss of income or opportunity by any Seeker

• Any reputational harm to any Kaster or Seeker

• Any harm to any third party affected by any role arranged through the platform

• Any conduct or events occurring after a role ends

• Any technical failures, outages, or errors on the platform

• Any currency conversion loss or international transaction fee

• Any outcome arising from alcohol, substances, or environmental conditions at any role location

• Any harm arising from the absence of background checks or user vetting

The platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. Our total liability to you for any claim arising from your use of this platform shall not exceed the total amount you paid to The Company, Inc. in the thirty days immediately preceding the claim.

21. Federal Platform Protection — Section 230

Kasting is an interactive computer service as defined under Section 230 of the Communications Decency Act (47 U.S.C. § 230). As such, The Company, Inc. is not the publisher or speaker of any content posted by users on the platform and is not liable for any content, roles, communications, or conduct originating from any user.

Kasting does not create, edit, curate, or direct any role posted on the platform. All content is generated entirely by users. Kasting's review and moderation activity — including removing content or terminating accounts — does not constitute editorial control and does not waive or limit our protections under Section 230.

By using this platform, you acknowledge that any claim arising from content posted by another user is a claim against that user, not against Kasting or The Company, Inc.

22. Indemnification

You agree to indemnify, defend, and hold harmless The Company, Inc., Kasting, its founders, officers, directors, employees, contractors, and agents from and against any and all claims, demands, lawsuits, damages, losses, costs, and expenses — including reasonable legal fees — arising from or related to:

• Your use of the platform

• Your violation of these Terms

• Your conduct during any role arranged through the platform

• Any claim by any third party arising from your actions on or off the platform

• Any tax liability arising from your earnings or payments through the platform

23. Intellectual Property, Content Ownership, And Non-Disclosure

All content, design, code, trademarks, service marks, logos, trade names, and materials on the Kasting platform are the exclusive property of The Company, Inc. and are protected by applicable intellectual property laws worldwide. You may not reproduce, distribute, modify, display, or use any Kasting intellectual property in any form without our express prior written permission.

Content You Submit

By posting, uploading, or submitting any content to the Kasting platform — including but not limited to profile information, role descriptions, photos, reviews, and communications — you grant The Company, Inc. a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute that content for any platform-related purpose.

You represent and warrant that you own or have the right to submit any content you post and that your content does not infringe the rights of any third party.

No Unauthorized Use Of Our Name Or Brand

You may not use the Kasting name, logo, brand, likeness, or any variation thereof in any manner, including but not limited to:

• Social media profiles, handles, or content

• Marketing, promotional, or advertising materials

• Any representation that implies endorsement, partnership, or affiliation with Kasting or The Company, Inc.

• Any public statement, press release, or media appearance made on behalf of or referencing Kasting without our express written consent

Unauthorized use of our brand or intellectual property will result in immediate account termination and may result in legal action.

Confidentiality And Non-Disclosure

By creating an account and logging into the Kasting platform — and at all times thereafter, regardless of whether your account remains active — you agree to the following:

You acknowledge that through your use of the platform you may be exposed to proprietary information including but not limited to platform mechanics, fee structures, payment triggers, dispute processes, matching logic, user flow, product design, business model, revenue structure, operational strategy, product roadmap, growth plans, pricing philosophy, and any other concepts or systems that are not publicly disclosed and constitute confidential trade secrets of The Company, Inc.

You agree that you will not:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code, architecture, or underlying logic of the Kasting platform in any manner

• Copy, replicate, or reconstruct any portion of the platform's design, mechanics, flow, or functionality for any purpose

• Disclose, share, or transmit any non-public information about the platform's operations, systems, mechanics, or business model to any third party

• Use any knowledge gained through your use of the platform to build, advise, fund, pitch, or contribute to any competing product or service

• Attempt to circumvent, manipulate, or exploit any platform mechanism, including but not limited to payment systems, review triggers, dispute processes, or matching logic

• Screenshot, record, or capture any in-app content, communication, user data, or platform interface for the purpose of distribution, replication, or exploitation outside the platform

This confidentiality obligation is binding from the moment of first login and survives account termination, deletion, or expiration indefinitely and without limitation of time. This includes but is not limited to any knowledge, impression, or understanding of Kasting's business model, revenue structure, operational strategy, product roadmap, growth plans, pricing philosophy, matching mechanics, and platform concepts gained directly or indirectly through use of the platform. You may not use, share, replicate, pitch, fund, build upon, or otherwise exploit any such knowledge in any capacity, in any industry, for any purpose, at any point in time, without the express prior written consent of The Company, Inc.

Breach of this obligation entitles The Company, Inc. to seek immediate injunctive relief, full damages, and recovery of all legal fees without limitation.

24. Account Termination

Kasting reserves the right to suspend or terminate any account at any time at our sole discretion, with or without notice and with or without cause. Upon termination for violation of these Terms:

• All platform fees paid are immediately forfeited

• Any held funds will be handled in accordance with our dispute resolution process

• The terminated user is permanently banned from creating a new account

25. Governing Law, Arbitration, And Class Action Waiver

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions, except where applicable law requires otherwise.

Any dispute arising from or relating to these Terms or your use of the platform shall first be attempted to be resolved through good faith negotiation between the parties. If unresolved within forty-five (45) days, either party may pursue binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable rules, except where prohibited by applicable law.

Nothing in this Section limits any rights, remedies, or protections that cannot be waived under applicable law.

You waive any right to participate in a class action lawsuit, class-wide arbitration, or representative proceeding against The Company, Inc. or Kasting to the fullest extent permitted by applicable law.

26. Changes To Terms

Kasting reserves the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Your continued use of the platform following notification constitutes your acceptance of the updated Terms. The current version of these Terms is always available at kasting.app/terms.

27. Severability

If any provision of these Terms, or any portion thereof, is found to be invalid, illegal, unenforceable, or contrary to applicable law by a court, arbitrator, or other tribunal of competent jurisdiction, such provision shall be modified and interpreted to achieve its intended purpose to the maximum extent permitted by law. If modification is not possible, the provision shall be deemed severed from these Terms. The remaining provisions shall remain valid, enforceable, and in full force and effect.

28. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Company, Inc. regarding your use of the Kasting platform and supersede all prior agreements, understandings, and representations.
